Interesting questions. It is difficult to disagree with your thoughts. I allow myself to update the above, by referring to art. 43, of Decree Law no. 34/2020 (Decreto Rilancio), that has cancelled art. 185-ter of Italian Industrial Property Code: now the Fund's objectives, intervention instruments and range of potential "beneficiaries" (no longer limited to companies owning historical trademarks of national interest but also to corporations with at least 250 employees) are therefore extended, and the obligation to provide information and sanctions have been repealed.
