UK: England And Wales Cricket Board Ltd & Anor v. Tixdaq Ltd & Anor, High Court of England and Wales, Chancery Division, HC-2015-002993, 18 March 2016

judge hammer

The court held that the operators of a website and mobile applications had infringed the claimants' copyright in TV broadcasts and films of cricket matches by allowing users to upload, view and share short clips of cricket match broadcasts. Fair dealing for the purposes of reporting current events in accordance with s30(2) CDPA did not apply as the dealing at hand could not be considered fair as the defendants' activities were commercially damaging to the claimants and the amount of the works taken could not be justified by any informatory purpose in the use.
